(NDPS)Narcotic Drugs and Psychotropic Substances Act (1985)
To put it in as it is in the law books “it is illegal for a person to produce/manufacture/cultivate, possess, sell, purchase, transport, store, and/or consume any narcotic drug or psychotropic substance.”
Who all come under this act:-
The Act has been amended twice – in 1988 and 2001. The Act extends to the whole of India and it applies also to all Indian citizens outside India.
Description of the act:-
“To make stringent provisions for the control and regulation of operations relating to narcotic drugs and psychotropic substances, to provide for the penalty for wrong doing of property derived from, or used in, illicit traffic in narcotic drugs and psychotropic substances, to implement the provisions of the International Convention on Narcotic Drugs and Psychotropic Substances and for matters connected therewith.”
There are 236 substances that come under this act that are considered to be illicit. Lets list few among these:-
- Acetorphine, Acetyl-alpha-methylfentanyl, Acetyldihydrocodeine, Acetylmethadol, Alfentanil, Allobarbita, Allylprodine
The following are the punishments that one may face violation of the NDPS act:
1>small quantity, with rigorous imprisonment for a term which may extend to 6 months, or with fine which may extend to 
10,000 or with both
2>quantity lesser than commercial quantity but greater than small quantity, with rigorous imprisonment for a term which may extend to 10 years and with fine which may extend to 1 lakh Rs.
3>commercial quantity, with rigorous imprisonment for a term which shall not be less than 10 years but which may extend to 20 years and shall also be liable to fine which shall not be less than 1 lakh but which may extend to 2 lakh.
